		<description>I too would be interested in purchasing a cookbook! :)  I&#039;m brand new here and I have to say, although I have not yet tried any of the recipes, I can see the love that has gone into each and every one!  My son and I suffer from food allergies (Corn, Soy, Wheat, Rice, Peanuts) and it&#039;s always a joy to be able to find recipes of familiar past foods that we can eat again! I would love to know where to find the blueberry &quot;popover&quot; recipe that you feature in this post so I can make, devour and share with the world YOUR (link!) to all YOUR hard work to make my mouth and tummy so happy! ;)  Thank you so very much for all you do! 
P.S. I think what I appreciate most about your blog over ALL the numerous (gluten-free, allergy friendly, etc.) blogs I&#039;ve seen is that you are kind enough to include substitutions! As far as all the legal ins &amp; outs, the discussion here simply made my  head spin. I don&#039;t understand why a post you write ( a recipe where you write about how you developed it, etc. is like a blog post) should not be copyright-able. Sigh. I certainly don&#039;t want my online writings stolen. I suppose with recipes it&#039;s a bit different in the minds of the &quot;stealers.&quot; What if you made your recipes more easily linkable?  For example, begin AND end the posts with:  &quot;Remember to share my recipes if you like them by LINKING here; do not copy this content to your blog without my permission. Email me HERE for permission if you wish to use this content within your blog.&quot;  At least in that way the stealers will think twice, &amp; it gives all an easier route to &quot;do the right thing&quot; without a second thought. I just recently came across your blog because my coeliac daughter has met a friend with &#039;too many to list&#039; allergies and I wanted to be able to provide him (as well as the other kids) some &#039;familiar to everyone&#039; goodies when he comes over for playdates.  I, too, am not a blogger, so no worries, but your concerns have ...well... raised some concerns.  I was excited to test out your recipes until this post.  Unfortunately, it has risen a great concern of &quot;Oh my, I don&#039;t want to violate any laws (and then what? Be arrested?) by trying to help a youngster simply feel like the rest of the kids when it comes to snack time and share the triumph of the &#039;experience&#039; with my family and friends whom live out of state.&quot;    

I have enjoyed reading through your recipe list with your &#039;recreations/adaptations&#039; of the candy bars,  but I do have a question about your &#039;adaptation&#039; of these particular recipes, such as the &#039;Samoas&#039;.  I noticed you didn&#039;t credit the original creator, yet they are titled and even recreated to look as dead on duplicates. I haven&#039;t had an opportunity to research this, nor do I know the original creation date by the original creator, but, if the original creator of the Somoas is still alive and kicking, do you imagine him/her stewing over the idea of filing copyright infringement, or appreciating the fact that you are creative enough to extend the availability of such a wonderful concept to those whom couldn&#039;t have enjoyed such a thing before now?  (I also hate to mention this, but this world is cruel and tends to favor those who have more green $$$ than others, but how many times do you hear of a corporation &#039;creating&#039; a product and someone saying, &quot;Dang, I thought of that first....should&#039;ve....could&#039;ve....etc, etc, etc&quot; ?? Now that you have gone through the hard work of creating an alternative to the original and posting it to the world wide web, how sad would it be if an existing, bigger snack food manufacturer were to coin in on your time and money spent getting to this point  because of the enormous demand of pre-made, ready to eat right now, allergy-free products, except they&#039;ve covered their &#039;legal tracks&#039; because they bake it in an industrial oven and not a household oven, or they use an industrial mixer not a Vitamix ?  This similar situation happened to a wonderful, well-known gluten free blogger and cookbook author, and if I remember correctly, she stated she is not entitled to compensation because of this tragic loophole. Nor did it initiate the police to go knocking on the manufacturer&#039;s door.)        

My concern stems from you mentioning a &#039;set of rules&#039; to abide by during recipe creation and you mentioned certain actions were actually &quot;illegal&quot; but did not quote the source of that information.  Do you mind providing a link to a source?  Maybe providing a source would clear much of the confusion dust cloud, at least that I am experiencing.  Such as, according to copyright law ( http://www.copyright.gov/fls/fl122.html ) &quot;Only original works of authorship are protected by copyright. “Original” means that an author produced a work by his or her own intellectual effort instead of copying it from an existing work.&quot; And, &quot;Copyright law does not protect recipes that are mere listings of ingredients.&quot; ... &quot;Copyright protection may, however, extend to substantial literary expression—a description, explanation, or illustration, for example—that accompanies a recipe or formula or to a combination of recipes, as in a cookbook.&quot; (i.e. the instructions of how to manipulate the ingredients may be copyrighted.) 		<description>The problem with copyrighting a list of ingredients is that there are many foods which are basically the same ingredient list simply by nature, but how you process those ingredients and the specific way in which you phrase your directions and other information is.  You can make an argument for the proportions within the recipe being unique, but it&#039;s a really hard argument to make and generally wouldn&#039;t stand up in small claims court if you were to go that far. For example, my best friend and I have a gingersnap recipe which is identical in ingredients, but the way you make the cookie is totally different and leads to a different ending.  It&#039;s that specific process and how it&#039;s stated which is a copy right thing.  Can&#039;t copyright an idea, but you can copyright the expression thereof.  :)  

I do agree that it&#039;s very rude though and annoying to find your recipe, down to the brass tacks, on some other website.  A link back to your site is definitely the better way to go, or talking about a personal experience with the recipe and then linking back.  The point should be to both give you the credit and the traffic as much as possible.  And I find with a lot of bloggers, particularly food bloggers, if they do it wrong it&#039;s usually not intentional and they&#039;re very kind about adjusting the post to properly link back.  It&#039;s part of what I love about the food community.  I think we have a higher percentage of just plain cool folks out here.</description>

		<description>As a relatively young blogger ( my blog is a little over a year old) I am still learning the ropes, and the &quot;rules&quot; so to speak.  But I try to be very careful and not plagiarize recipes.  Most of my first recipes were ones from cookbooks that I changed and made dairy free, but I then gave credit to the book.  Others are ones I have come up with on my own or from friends. Today was the first day I shared a recipe from another blogger, but I emailed her first to get her permission, then once I had her blessing to share it I re-wrote the recipe in my own words and used my own pictures.  I also linked back to her twice in the post, and again on my Facebook page.  Is that acceptable?  
I am not blogging to be popular .  I am not  doing this for income. I do this because I had a very had time at the beginning of my dairy free lifestyle 5 years ago so I want  to help others who are going through what I went through. And to connect with others that I can learn from. I certainly have huge amounts of respect for the professionals, and I am in no way anywhere near that league.  I just hope I am doing it right!</description>

It would seem to be much more courteous if bloggers shared only with the permission of the author as they do with books. It&#039;s almost like being a doctor at a party, isn&#039;t it? Everyone wants something either for free or that they don&#039;t have to work for.
Years ago my husband worked for a home builder. People would ring our doorbell at 9 or 10 o&#039;clock at night or come on the weekend and DEMAND that he go check their jobsite because there was something they didn&#039;t like or didn&#039;t approve of. Worse, they&#039;d come on the weekend and insist he go and do something about &#039;their house.&#039; He wasn&#039;t getting paid for those hours and until the closing they didn&#039;t even own the property. What I&#039;m getting at is that is appears to be human nature to abuse others in whatever manner they can. They&#039;d be appalled if the situations were reversed. If it&#039;s a very large site that is copying word-for-word my recipes and I believe that site might pop up first in a search engine, or the entire site is built as a scraping site, I get upset. Had you taken that recipe and placed it into your own blog and said &quot; adapted from&quot;  and the only change you made was putting in Jules flour then- you would be in the wrong. When bloggers do this they are basically taking content that is not theirs to promote their own website.

<p>Had you taken that recipe and placed it into your own blog and said &#8221; adapted from&#8221;  and the only change you made was putting in Jules flour then- you would be in the wrong. When bloggers do this they are basically taking content that is not theirs to promote their own website.</p>
